Terms of Service
Please read these terms carefully before using BotFabric.
1. Definitions
“BotFabric” ("we", "us", "our") refers to Fixio, registered in the Netherlands. “Service” means the website, the bot‑building platform, and any related tools or documentation. “User” ("you") means any individual or entity that accesses or uses the Service.
2. Acceptance of Terms
By accessing or using the Service you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts. You represent that any information you provide is accurate and complete.
4. No Financial Advice
The bots generated through BotFabric are for educational and experimental use only. We are not a licensed financial advisor, broker, or dealer. Nothing in the Service constitutes investment advice or a recommendation to buy or sell any financial instrument. You assume full responsibility for all trading decisions and outcomes.
5. Orders & Delivery
Upon successful payment, you will be able to configure and immediately download your bot files. All digital goods are deemed “delivered” when the download link is provided. Because products are digital and tailored, all sales are final and non‑refundable, except where required by law.
6. Pricing & Payment
Prices are listed in euros (EUR) and include VAT where applicable. We reserve the right to change prices at any time. Payments are processed securely by Stripe. We do not store full payment‑card details.
7. Intellectual Property
All content, code, trademarks, and branding on the Service remain the sole property of BotFabric or its licensors. You receive a non‑exclusive, non‑transferable license to use generated bot files solely for personal or internal business purposes.
8. License Restrictions
You may not resell, sublicense, distribute, decompile, or modify the generated code for commercial redistribution without prior written consent. Any breach terminates your license immediately.
9. Risk Disclosure & Disclaimer
Trading foreign exchange, CFDs, or other financial instruments carries significant risk and may result in loss of capital. Past performance does not guarantee future results. The Service is provided “AS IS” without warranties of any kind, express or implied.
10. Limitation of Liability
To the maximum extent permitted by law, BotFabric is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or trading losses, arising out of or related to your use of the Service, even if we were advised of the possibility of such damages. Our total liability shall not exceed the amounts you paid in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless BotFabric, its directors, employees, and affiliates from any claim or demand (including reasonable attorneys’ fees) arising out of your use of the Service or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, all licenses granted to you end immediately.
13. Governing Law & Venue
These Terms are governed by Dutch law. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands, unless mandatory law gives you the right to litigate elsewhere.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be announced at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
