By accessing or using BotFabric Forex ("the Service", "the Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and BotFabric, a product operated by fixio.me, registered in the Netherlands ("we", "us", "our").

BotFabric Forex is a Software-as-a-Service (SaaS) platform that provides a downloadable desktop application and web portal for forex traders. Core features include:

• Local AI market research and analysis via Ollama (all processing occurs on your device)
• MetaTrader 5 integration through a local Python bridge
• Chart analysis, MES scoring, and market research in the desktop workflow
• Desktop application access and local setup tooling
• Multi-language interface (English, Dutch, German, French, Spanish)

The Service requires an active subscription after the free trial period ends. Access may be suspended if payment fails.

Free Trial: Promotional trial access may be offered from time to time. A valid payment method may be required to activate the offer. You will not be charged during the active trial period.

Auto-renewal: After the 30-day trial, your subscription automatically activates and will be billed monthly at the applicable BotFabric rate published on the pricing page. You will receive an email reminder at least 3 days before your first billing date.

Cancellation: You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing cycle. No partial-month refunds are issued.

Plan changes: If subscription structure changes in the future, changes take effect according to the pricing terms shown at checkout or in your billing portal.

Failed payments: If a payment fails, we will attempt to retry for up to 7 days. If the payment cannot be collected, access to the Service will be suspended until the outstanding balance is settled.

All prices are in Euros (EUR) and inclusive of applicable taxes where required by law. Stripe processes all payments — we never store your card details.

BotFabric Forex is a software tool only. Nothing on this platform constitutes financial advice, investment advice, trading advice, or a recommendation to buy, sell, or hold any financial instrument.

Trading foreign exchange (forex) and related instruments carries a high level of risk and may not be suitable for all investors. The value of your investments may go down as well as up. You may lose all or more than your initial investment.

Any AI-generated analysis or signals produced by this platform are for informational and educational purposes only. Past performance indicated by any AI output does not guarantee future results. You are solely responsible for all trading and investment decisions you make.

We strongly recommend consulting a qualified and regulated financial advisor before making any trading or investment decisions.

You agree not to:

• Reverse engineer, decompile, or disassemble the desktop application or platform code
• Share, sell, or transfer your account credentials to any third party
• Use the Service to engage in any fraudulent, illegal, or unauthorized activity
• Attempt to gain unauthorized access to other users' accounts or our infrastructure
• Use the Service in any way that violates applicable laws or regulations in your jurisdiction
• Resell or sublicense access to the Service without prior written consent from us
• Use the Service to manipulate markets or violate broker terms of service

Any violation of these rules may result in immediate account suspension or termination without refund.

The BotFabric Forex platform, website, branding, UI, and underlying source code are the intellectual property of BotFabric / fixio.me and are protected by applicable copyright and intellectual property laws.

Your generated content: Analysis notes, summaries, and AI-generated outputs created from your own prompts and configurations remain yours. We make no ownership claim over those outputs.

Feedback: Any feedback or suggestions you provide may be used by us to improve the Service without obligation or compensation.

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice where possible. We reserve the right to modify, suspend, or discontinue features of the Service at any time.

We will notify you of material changes to these Terms at least 14 days in advance via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, BotFabric / fixio.me shall not be liable for:

• Any trading losses, financial losses, or investment losses arising from use of the Service
• Loss of data, including local app data or AI-generated content
• Indirect, incidental, special, consequential, or punitive damages
• Any damage arising from unauthorized access to your account

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount you paid to us in the three (3) months immediately preceding the claim.

You may terminate your account at any time by cancelling your subscription and contacting us to delete your account data. We may terminate or suspend your access immediately, without prior notice or liability, if you breach these Terms.

Upon termination, your right to access the Service ceases immediately. Account data is retained for 30 days after termination then permanently deleted, unless a longer retention period is required by law.

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Service shall first be attempted to be resolved amicably. If no resolution is reached within 30 days, disputes shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.
